365Daily – The Court on Thursday, January 25, 2024, affirmed Siminalayi Fubara as the duly elected governor of Rivers State.
In a unanimous decision, the court dismissed the appeal brought by the All Progressives Congress (APC) candidate, Tonye Cole, against Fubara’s election.
Delivering the judgement, the court stated that Cole did not establish the allegations of non-compliance with the Electoral Act, among others.
It also held that his appeal was incompetent and lacked merit.
Cole had petitioned the court over Fubara’s victory based on the claim that he did not resign from his position as Rivers State’s Accountant-General before going for the election.
He also alleged anomalies, disregard for the Electoral Act, and corrupt activities by Fubara, and requested that the Court of Appeal and Tribunal’s rulings which affirmed Fubara as governor should be overturned.
